This is all the information and details that we need to share with you when using our website and purchasing our products and services.

The following terms and conditions control the offering and selling of products and services at modeface.co.uk

Website owner, the offering, and binding of Terms

This website is owned and operated by Modeface Ltd. These Terms set forth the terms and conditions under which you may use modeface.co.uk and the services offered by us. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Modeface except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

Right to suspend or cancel user account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

Indemnification

You agree to indemnify and hold Modeface Ltd harmless from any demands, loss, liability, claims or expenses (including legal fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Modeface Ltd be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Modeface assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United Kingdom, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in England. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

General conditions of sale acceptance

Customers should review the general conditions of sale and privacy policies on the website before making any purchases. If a customer proceeds with a purchase, it is assumed that they have given full acknowledgment and agreement to such policies, and without such acceptance, purchases should not be made.

Through purchasing a product or products, customers are accepting the general terms and conditions of the sale, including the payment, as well as reading in full the privacy policy. The customer will have given clear consent for the processing of personal information and agrees to comply with any stipulated agreements, including the payment method.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

How to purchase

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for our products and any subscription will be listed on the website. We reserve the right to change the prices displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing is available on the payments page.

If purchasing a paid plan, that Modeface Ltd may offer from time to time, a subscription fee will be charged on a monthly basis to your chosen payment method This payment will be set for 12 monthes. Paid plans will not renew automatically. You may cancel your subscription at any point although the option to resubscribe may not be available to you until the original annual renewal date.

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Reward Scheme

Rewards are only redeemable if you are a member and have signed up for our free rewards scheme modecoin. You may receive rewards in the form of modecoin for signing up, referrals, purchases and more dependent on the offers MODEFACE has running at the time. Coins that you have earned will be able to be used at the checkout when you make a purchase. 1 modecoin is the equivalent of £1 or can be issued as a fixed % discount modecoin.

 

Rewards are set by ModeFace Ltd and may be changed or removed at any point at the discretion of Modeface Ltd. Points have no redeemable cash value and may only be used   at the checkout when you make a purchase on www.modeface.co.uk.

Discounts and Vouchers

If more than 1 automatic discount applies on an item, the largest discount will be applied to that item, or group of items, in the Cart and Checkout Pages, The cart will also only allow you to enter 1 Promo Code. If you have more than 1 brand with a Promo Code you will be required to make a separate purchase to use Promo Codes on the other qualifying items.

Methods of Payment

Payment must be made by one of the options accepted and displayed on the website, any payment must be made. The validity of a payment will be checked by the provider during the order process. Shipment will occur once payment has been confirmed.

Product prices are subject to change, confirmed orders may or may not be affected by any such alterations.

Modeface Ltd will not be held responsible for any delay or non-delivery of items if the provider or institution refuse payment for any reason. Modeface Ltd reserves the right to automatically cancel any order in the absence of relevant information needed to complete a transaction. We also reserve the right to obtain additional information from the customer, as well as request documents to prove the ownership of credit cards. Modeface Ltd also reserves the right not to accept the order without any right for the Customer to claim damages.

Information from the buyer’s credit card or financial information will at no time be known by Modeface Ltd. Such information is transmitted through a secure and safe connection to an online portal for the bank or finance company provided. Therefore, Modeface will not be held responsible for any fraudulent or illegal use of credit cards which may potentially occur during the transaction of a purchase.

Should the customer cancel an order reserved with payment by credit card or bank transfer, Modface will reimburse through the same chosen method of payment made by the Customer.

Delivery

Modeface Ltd delivers worldwide. Our freight partners are UPS, DHL and FedEx. The average delivery time is estimated 1-3 business days for the EU and at 5-7 business days for the Rest of the World, following dispatch. However, delivery times may increase depending on the delivery destination, and delivery times could also change due to global conditions.

You will be advised of your products delivery status and provided a tracking number once the parcel has been processed by the relevant courier for transportation

Invoices for orders delivered by couriers are available to both download and print online from the customer’s individual account area. Once such information has been issued, no changes can be generated.

Products are dispatched from Modeface Ltd distribution hubs within 1-3 business days after the order payment has been confirmed, and are always subject to checking the regularity of the payment before dispatch. In the unlikely event that a product has not been delivered after 10 working days following the order confirmation, customers should send a direct email to support@modeface.com with the subject line “NON-DELIVERY”, providing their order number as well as any other additional information. Having received the email, Modeface will contact the customer to resolve the problem, or in some cases offer an explanation for the non-fulfilment of orders.

For an undelivered package that is returned to the vendor, the buyer will need to cover a fixed fee of £50 which will be invoiced for or deducted from the refund. Returns due to wrong shipping information provided, such as name or address, will be covered by the buyer with a fixed fee of £50.

Customs operations are handled by Modeface and its partners together with the selected freight provider customs agency.  Additional customs charges for shipments from the EU to the UK will be covered by Modeface.

Refunds and Returns

We offer a 14-day return policy from the day the package is delivered. Returns that are posted after the 14-days will be rejected and shipped back to the original dispatch address.

For defects and wrong shipped items, the customer must contact Modeface Ltd by completing and submitting the Returns Form within 14 days. The emails must include the date of purchase and delivery, description of the damage and photographic evidence. Following this a return label will be provided to have the defective/wrong item shipped back to our distribution partners.

 

When returning unwanted items the sender is responsible for all fees and items must be shipped back via UPS, DHL, or Fed Ex with an active tracking number. The customer must complete the returns form to initiate the return and select how they wish to complete the return. The customer can either purchase a returns label through Modeface or return the item themselves to the returns address provided. In both cases the customer is responsible for the cost of the return.

All returns must be in perfect original condition as the original shipment, along with any original attachments such as tags, boxes, or dustbags. We have the right to refuse returns if the products have been worn or washed and with a used scent. For declined returns, the order will be shipped to the buyer and any additional shipping charges will be invoiced.

Any agreed refunds will be made by bank transfer or by PayPal within 5 business days of received and approving the returns.

 

 

 

Privacy Policy

Modeface will be the “owner” of customers’ data and all the information concerning the use of their personal data is summarised in the privacy document, in accordance with the Protection of Personal Information legislation. Customers must, therefore, accept such a policy before proceeding with any purchases, with a particular focus on the following areas:

Purposes of data processing. Commercial, promotional, and/or sales purposes to identify potential customers for each specific product or service (eg, statistics, customer satisfaction feedback, the preliminary gathering of information aimed at reaching an agreement or provision of a service, etc.); Customer satisfaction research (eg research on the quality of services); Fulfilment of obligations under the law, regulations or legislation.

Data communication. The personal data collected by Modeface will be communicated and/or processed by people we trust, who, in pursuit of the above objectives, carry out operational, technical, and organizational tasks. The personal data provided by Customers are used only to perform the job or related services; the data are not disclosed to third parties unless such disclosure is required by law or is directly necessary for the fulfilment of requirements.

Rights of interested parties. – It is fully established that the customer has the option to exercise specific rights. The Customer may obtain: confirmation or otherwise of the existence of data concerning them, even if not yet recorded;

Information about the origin of personal data, the purpose and methods of processing it, and the basis of processing in cases where this is done using electronic instruments;

Indication of the identity of the Owner and the Person Responsible, and the persons or categories of persons to whom the personal data may be communicated or who have access to them;

The cancellation, transformation into an anonymous form, or blocking of data processed in violation of the law, as well as updating, rectification or, where interested, integration of data unless it is impossible or involves the use of disproportionate means. The Customer may also object, for legitimate reasons, to the processing of personal data about them, even if it relates to the purpose of the data collection. The Customer can also object to the processing of personal data for sending advertising material or otherwise, aimed at carrying out market research and business communications.

Complaints

Customers wishing to make a complaint can address their issues by email to Support@modeface.com. We will aim to provide an initial response within 2 working days and provide a finalised response within 10 working day.
